I recently helped the MD of a recruitment company who had two main concerns.
The first was how to cover himself in case one of his permanent placements went on to damage an IT system. If the recruit had “lied” on his CV about his abilities the company suffering the damage might take action against the recruitment company for not vetting the recruit carefully enough. They might suffer a loss of data, or even worse, custom.
Or they may simply refuse to pay their fees, perhaps alleging breach of contract. He wasn’t sure if he could be covered by insurance or whether this was one of the exclusions. We found that certain types of incident weren’t covered and he will now manage his recruiting process and adjust his T&C’s accordingly.
The recruitment agency insurance we recommended is useful if a client is refusing to pay their bill. Insurers will look into the circumstances and may pay the money owed to him rather than push the client into taking action. If there is no breach of contract he can take action to recover his money.
